Terms of Sale and Product Liability Disclosure
Thank you for choosing Banana Products, LLC. We value your business and strive to provide high-quality products. Please review the following terms, which automatically apply to all orders placed with Banana Products, LLC. By placing an order, you acknowledge and agree to these terms.
1. Inspection and Notification Policy
It is the customer’s responsibility to thoroughly inspect all products immediately upon receipt. Any issues, including but not limited to defective products, incorrect items, or damages, must be reported to Banana Products, LLC in writing within 10 days of delivery. After this period, Banana Products, LLC will not be able to assist with product returns, exchanges, or claims, and the products will be considered non-returnable and non-refundable.
Failure to report any discrepancies within the stated timeframe constitutes acceptance of the delivered goods as-is.
2. Incorrect Products
If you believe you have received a product that does not match your order, please notify us within 10 days of receipt. You must provide detailed information regarding the incorrect product, including order number and proof of delivery. Claims made after this timeframe will not be considered, and Banana Products, LLC will not be liable for any issues arising from incorrect products beyond the 10-day window.
3. Product Expiration and Shelf Life
Banana Products, LLC is not responsible for any product expiration or deterioration that occurs after the purchase date. Customers are advised to be aware of the shelf life of the products they purchase and to use them accordingly. Products are sold on an “as is” basis, and Banana Products, LLC does not guarantee the longevity or usability of any product beyond its stated expiration.
4. Final Sale and Non-Returnable Products
All sales are final once the 10-day inspection period has passed. Banana Products, LLC does not accept returns, refunds, or exchanges for any reason after this period. Additionally, products that have been used, altered, or damaged after receipt are not eligible for return or refund.
5. Automatic Enrollment in Terms Program
By placing an order with Banana Products, LLC, all customers are automatically enrolled in this product liability and terms of sale program. This program governs all transactions and purchases made through Banana Products, LLC and is applicable to all future orders. By continuing to purchase products from us, you accept these terms as legally binding.
6. Limitation of Liability
Banana Products, LLC shall not be held liable for any damages, losses, or claims resulting from the use or misuse of the products sold. This includes, but is not limited to, claims related to personal injury, property damage, or financial loss. Our liability is limited strictly to the replacement or refund of defective products reported within the stated timeframe, and in no case will our liability exceed the amount paid for the product in question.
These terms apply regardless of any indemnity contracts or agreements in place between Banana Products, LLC and the customer. Any such agreements do not alter or waive the conditions outlined in this disclosure.
